Complaints of odour nuisance are investigated where appropriate by Offaly County Council under the Air Pollution Act, 1987 Section 24(2) which states that "The occupier of any premises shall not cause or permit an emission from such premises in such a quantity, or in such a manner, as to be a nuisance.”
If you wish to make a complaint of odour nuisance you are requested to follow the guidelines on how to make an environmental complaint. Following the receipt of your complaint you may be requested to maintain a log of the odour for a period of at least one month using the odour complaint log form. This will assist the relevant environmental officer in their investigations.
Please be advised that common agricultural practices such as slurry spreading are not deemed to be an odour nuisance but a normal activity in a rural environment.
