Information Note for Owners Opting Out

New Building Control (Amendment) Regulations 2015.

Mr. Paudie Coffey, T.D., Minister of State at the Department of the Environment, Community and Local Government, has announced new regulations that will ease the application of the Building Control (Amendment) Regulations 2014 in relation to a single domestic dwelling on a single development unit, or a proposed domestic extension. Owners which include self-buildersnow have the choice to opt out of the general requirements to have construction works designed, inspected and certified by registered construction professionals in relation to such buildings.

Note 1: Please note that owners must still meet their legal obligation to submit a commencement notice, and to build in accordance with the minimum requirements of the current Building Regulations to ensure that dwellings are constructed in a safe and secure manner.

Note 2: It should be noted, that the newly amended Building Control (Amendment) Regulations 2015 which have come into effect, only relate to an owner occupied single domestic dwelling on a single development unit, or a proposed domestic extension. There is no change in respect of other types of developments, and the existing requirements under Statutory Instrument S.I.9 of the Building Control regulations 2014 will remain mandatory for all multi-unit developments in the country

Note 3: Homeowners should appraise themselves of any potential cost or other implications that may arise as a result of choosing to opt out of the statutory certification process prior to deciding on whether or not to avail of the opt out option. It is recommended that a homeowner should consult with their solicitor.
