Notice is hereby given that Offaly County Council, Water Services Authority for Birr Town and Environs, make a Proposal to take an increased supply of raw water from the Camcor River at Springfield Bridge, Clonoghill Upper, Birr in accordance with the Water Supplies Act 1942 amended by the Planning and Development Act 2000 - 2010 and the Water Services Act 2007 for the purposes of providing a supply of water to Birr Water Supply Scheme under the Local Government (Sanitary Services) Acts 1878 to 2001 and the Water Services Act 2007.
It is proposed to take a maximum rate of 5,258m3 per day. The ancillary operations in connection with this proposal shall consist of water abstraction works and associated raw water pumping facilities.
Offaly County Council, Water Services Authority has prepared in duplicate a list, referred to as the Book of Reference, showing the name and address of the Riparian Owners. The Proposal and Book of Reference has been deposited and may be inspected at the Offices of Offaly County Council, Water Services, Áras an Chontae, Charleville Road, Tullamore and Birr Civic Offices, Wilmer Road, Birr between the hours of 9.30 am and 4.00 pm each day from Monday to Friday, exclusive of Bank Holidays.
An open day will be held in Birr Civic Offices on Wednesday 13th July 2011 between the hours of 2pm and 7pm where representatives from Offaly County Council, Water Services Authority will be available to answers questions.
Any person who is aggrieved by the Proposal including those whose name does not appear in the Book of Reference may make an objection to the Proposal by giving to Offaly County Council, Water Services Authority a statement in writing of such objection and the grounds thereof before but not after Thursday 18th August 2011.
If no objection is duly made to the Proposal or if every such objection so made is withdrawn, the Proposal shall be deemed to be agreed to and Offaly County Council, Water Services Authority will be empowered to take a supply of water in accordance with the Proposal.
If any objection to the Proposal is duly made and is not withdrawn, Offaly County Council, Water Services Authority will apply to An Bord Pleanála for a Provisional Order declaring that the Proposal may come into force.
In the event of Offaly County Council, Water Services Authority being empowered to take a supply of water in accordance with the Proposal, compensation will be payable in respect of damage (if any) caused to any person by the taking of such supply of water. Such compensation will be determined in accordance with the provisions of the Water Supplies Act 1942 amended by the Planning and Development Act 2000 - 2010 and Water Services Act 2007.
